  • Content: Any materials, reports, analysis, or documentation provided by Aletheia to the client.

     

3. Scope of Services

Aletheia specializes in construction consulting, project management, dispute resolution, claim preparation, risk mitigation, and related professional services. The specific services to be provided will be outlined in a separate agreement or proposal between Aletheia and the client.


4. Client Obligations
 

  • Accurate Information: Clients must provide accurate and complete information necessary for Aletheia to deliver its services effectively.

  • Timely Cooperation: Clients are required to cooperate in a timely manner, including providing access to documents, resources, and individuals as needed.

  • Payment: Clients must ensure payments are made in full and on time as per the agreed-upon terms.

  • Compliance: Clients must ensure their project complies with local laws, regulations, and industry standards.

     

5. Service Limitations

Aletheia provides consulting and professional advice based on industry standards and the information provided by the client. Aletheia does not guarantee specific outcomes or assume liability for decisions made by clients based on its recommendations.


6. Confidentiality
 

  • Client Information: Aletheia will protect the confidentiality of all client-provided information unless disclosure is required by law.

  • Proprietary Information: Any reports, methodologies, or documentation provided by Aletheia remain the intellectual property of Aletheia and cannot be shared, distributed, or reproduced without written permission.

     

7. Fees and Payment
 

  • Pricing: Fees for services will be outlined in a proposal or agreement and are subject to change based on project scope adjustments.

  • Payment Terms: Payment is due as per the terms outlined in the agreement. Late payments may incur additional fees.

  • Cancellations: If a client cancels services after initiation, Aletheia reserves the right to charge for work completed up to that point.

     

8. Liability and Indemnity
 

  • Limitation of Liability: Aletheia is not liable for indirect, incidental, or consequential damages resulting from the use of its services.

  • Indemnification: The client agrees to indemnify Aletheia from any claims, damages, or expenses arising from the client’s use of services or violation of these Terms.

     

9. Termination of Services

Either party may terminate services by providing written notice. Upon termination:

  • The client must settle any outstanding payments for work completed.

  • Aletheia will provide all deliverables completed up to the termination date.

     

10. Intellectual Property

All reports, methodologies, and deliverables created by Aletheia remain its intellectual property. The client is granted a non-exclusive, non-transferable license to use the deliverables solely for the purpose they were intended.


11. Dispute Resolution

Any disputes arising under these Terms shall be resolved through mediation. If mediation fails, disputes will be settled in a court located in Ontario, Canada.


12. Privacy Policy

Aletheia respects client privacy and adheres to all applicable data protection regulations. For more information, please refer to our Privacy Policy.


13. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada. Any legal action or proceeding related to these Terms shall be exclusively brought in the courts of Ontario.


14. Amendments

Aletheia reserves the right to update or modify these Terms at any time. Changes will be effective upon posting to our website, and continued use of our services constitutes acceptance of the revised Terms.
